Two Rivers, a Lake and Lots of Boats

The Gold River, California region, with its proximity to two large rivers and Folsom Lake, is a hot spot for boating, especially given the summer temperatures.  Safety on the water is an essential consideration.  Our Gold River personal injury lawyers hear about many accidents every year on the local waterways.  Some, unfortunately, result in severe injuries, occasionally even fatalities.  Having some understanding of why boating accidents occur can help you prevent such tragedies and enjoy a worry-free afternoon on the water.

According to the U.S. Coast Guard, the main causes of watercraft accidents are negligence and human error.

1: Inexperienced Boat Operators

Operating a boat is a big responsibility.  Before taking on that role, the boat operator should become familiar with the rules of the water as well as the mechanics of the particular watercraft they will be in charge of. Inexperienced boaters would greatly benefit from taking a course in watercraft maintenance and operation, maritime law, California boating regulations, and emergency protocol.  Inexperienced boaters should consider partnering with a seasoned boater the first few times going out.

2: Inattention

Distraction and inattention are some of the leading contributors to boating accidents.  There are many variables associated with the navigation of lakes, rivers, and oceans.  Close attention and avoidance of distractions are required by the boat operator in order to avoid danger.  Other factors to which close attention must be paid is the weather, other watercraft, and their passengers.

3: Failure to Keep a Proper Lookout

Clear visibility is crucial for the boating operator, and failure to maintain a proper lookout is another common cause of boating accidents.  Whenever possible, a passenger on the boat should assist in keeping watch for hazards such as debris, swimmers, other boats, or personal watercraft

4: Improper Speed

Waterways in California have speed limits to facilitate safety for recreational watercraft users.  The boat operator is required to know the speed limit for the waterway on which they are boating and to stay within that limit.  Speeding can lead to collisions and capsizing.

5: Boating Under the Influence

Alcohol use by boat operators and passengers factors into about 25% of all motorboat accident fatalities in California.  In fact, alcohol is a leading contributor to fatal recreational boating incidents.  The legal limit for blood alcohol content (BAC) for California boaters is the same as that for automobile operators, 0.08%.  All boat passengers and operators of watercraft need to be aware that consuming alcohol can negatively affect the safety of their recreational pastime.

6: Improper Watercraft Maintenance

Routine inspection of safety and operational equipment is critical to safe boating.  A mechanical failure affecting the operation of the boat can cause accidents.  Safety equipment also needs to be in proper working order.  The boat operator is responsible for the inspection and maintenance of the watercraft’s mechanical and safety equipment.
