Woman Wins $6 Million in Truck Accident Case
A woman, who had suffered severe injuries in an accident involving a large commercial truck, recently received a $6 million settlement for her damages.
How Did the Truck Accident Happen?
While driving on a highway one late evening, the woman’s vehicle ran out of gas. She moved her car entirely onto the shoulder lane and called for roadside assistance. While the technician was working on her car, the driver of an 18-wheeler came upon the scene while drifted out of his lane and collided with her vehicle at a high rate of speed. The woman was in the driver’s seat at the time of the impact. Sadly, she was ejected from the car and propelled 30 feet away from the point of impact.
Physical and Emotional Trauma
The woman suffered severe bodily injuries and emotional trauma. She also suffered a mild traumatic brain injury (TBI) which caused short-term memory loss. Her brain injury has affected her life in many ways. She can no longer work, function normally, or enjoy life. Her doctor, family, friends, and co-workers had all confirmed this. She still experiences ongoing dizzy spells and diminished memory functions. Her doctors said these symptoms are permanent, and she will continue to experience them for the remainder of her life. She has chronic pain in her right knee and left shoulder and is still being treated for these injuries.
Pretrial Discovery
The woman retained an experienced personal injury lawyer to assist her. During pretrial discovery, it was disclosed that the truck driver fell asleep at the wheel, which caused the accident. During discovery, it was revealed that the truck driver should never have been on the job because he had numerous on-the-job accidents previously. It was also learned that he should have been dismissed from his job due to other negative aspects of his driving record. Claims against the truck company and its driver included negligence and wantonness. Additional claims lodged against the trucking company included negligent hiring, training, and supervision.
Time Limit to File a Truck Accident Claim
Accidents involving a large commercial vehicle can cause devastating and life-changing injuries. If you were hurt in a large truck crash and plan to file a lawsuit in court, you will need to act fast because there is a small window of opportunity to do so. The statute of limitations is two years from the accident date in California. If the injured person is a minor, the time can be extended beyond two years. If the claim is against a government entity, you have only six months of the accident to file a claim. To ensure you are filing within the statute of limitations, speak to a personal injury attorney experienced in trucking litigation.
