Things to Know About Injury Cases for Fresno Auto Accidents
Any roadway crash in Fresno, California, may lead to a damaged vehicle and someone getting injured. If a recent car accident injured you, it is essential to know your options for financial recovery. California law may have a significant impact on a personal injury case you file. This includes the statute of limitations. According to CCP 335.1, lawsuits for personal injury are subject to two-year deadlines. In other words, an injured party has up to two years from the date of a traffic collision to file for personal injury in civil court. Conversely, California’s comparative fault rule may decrease a claimant’s financial recovery based on the percentage of negligence assigned to them for an auto accident.
Evidence is key to any personal injury claim stemming from a roadway crash. Evidence useful for proving an injury case includes medical records and summaries, police reports, statements by eyewitnesses, testimony from expert witnesses, video surveillance footage of the crash site, and more. Remember that if the evidence is not immediately secured following a crash, it may be destroyed or lost over time. Therefore, it is essential to act quickly and understand your rights under California law.
If another party or entity is responsible for the incident and the resulting injuries, they should be held liable for damages incurred. An accident attorney can make that possible by using their experience, skills, and resources to build a strong case for maximum compensation. That starts with gathering and preserving evidence, working with expert witnesses, determining and calculating damages, and negotiating with the insurance company that represents the negligent party or your insurer.
