Man Killed After Fatal Hit and Run Crash in Fresno
A man caring for his grandchild was killed in a fatal hit and run crash at an intersection in central Fresno on the night of Saturday, September 12, 2020. Officers from the Fresno Police Department (Fresno PD) were called to the scene of a pedestrian accident at the intersection of Weber Avenue and Clinton Avenue around 7:20 p.m. Arriving officers found a toddler and a 60-year-old man in the traffic lanes of Weber Avenue, just north of the intersection. The driver of the vehicle involved in the injury incident allegedly left and got onto Highway 99.
Several good Samaritans reportedly stopped and rendered CPR to the man and the toddler before the arrival of Fresno PD. The child suffered bruises and bumps and is expected to be okay. The grandfather of the toddler was transported to a local hospital for treatment. Sadly, he was pronounced deceased during hospitalization. The Fresno County Coroner’s Office has withheld his name until his family has been notified.
How to Prove Negligence in a Wrongful Death Accident Case
Proving negligence on the part of a driver in a fatal pedestrian accident case can be challenging, given factors such as walking paths and crosswalks. Hit and run accidents often claim the lives of people on foot, requiring an independent investigation by an experienced accident attorney to support a wrongful death claim.
At AutoAccident.com, our Fresno personal injury lawyers have decades of experience handling wrongful death pedestrian accident cases. Our legal team utilizes the expertise of accident reconstruction experts who can review the details of the fatal incident, examine property damage, analyze skid marks in the road, and evaluate witness statements and police reports to properly determine fault. Our wrongful death attorneys can also gather evidence of the at-fault party’s liability, including video surveillance of the accident scene, and work with investigators to locate them after a hit and run.
Can Insurance Cover a Fatal Hit and Run Crash in Fresno?
There are some situations where a driver responsible for a hit and run pedestrian accident is not found. Under such circumstances, your Fresno personal injury attorney will look into other options for recovery of wrongful death damages, such as uninsured motorist coverage (UM). This type of insurance provides protection in a motor vehicle accident caused by a driver with no bodily injury liability coverage. UM may also pay for damages resulting from a hit and run accident involving a cyclist or pedestrian.
If the decedent did not have insurance at the time of the fatal incident but lived with someone who did and carried UM, a wrongful death claim may be filed against that policy so long as the deceased was not listed as an excluded member.
