A man in his 50s was killed following a collision on Highway 152 at County Road 16 in Madera County. The accident happened just before 7:00 am on December 13, 2022. According to the California Highway Patrol (CHP), a motorist driving a Mustang along County Road 16 reportedly ran a stop sign and crashed into the side of a Honda.

Losing a Loved One in a Preventable Accident

Coming to terms with the unexpected loss of a loved one is painful and overwhelming. Nothing may undo the pain or replace the person you loved, shared life with, and depended on for companionship. However, if the death was due to a collision caused by someone else’s carelessness, help may be available. Surviving family members may be entitled to hold the negligent party liable for their actions through a wrongful death claim.

What to Know About a Wrongful Death Claim

A wrongful death is the loss of a family member in an accident caused by the negligent actions of another person. When this happens, the decedent’s family is often left behind to figure out how to pick up the pieces. California law allows survivors to take legal action against the responsible party through a wrongful death claim for financial compensation.

If you have lost someone you love in a preventable accident and believe another person is to blame, it is essential to discuss your case with an accident attorney that knows what it takes to independently investigate these types of claims.

Limited Time to File a Wrongful Death Claim

In California, family members only have two years from the car accident date to file a lawsuit. This is known as the Statute of Limitations. Failing to file a lawsuit before the statute runs out may result in the dismissal of your case. You will lose your right to take legal action and seek compensatory damages. Since many factors are involved, working with an experienced wrongful death lawyer is essential.
