Manteca Man Dies in Motorcycle Crash

A Manteca man was killed in a recent motorcycle accident involving another car. The crash occurred in Manteca around 6:45 p.m. on Lathrop Road, just east of Union Road, the Manteca Police Department reported. Emergency responders were requested at the scene to perform life-saving measures on the injured motorcyclist. Sadly, their efforts were unsuccessful as the rider succumbed to his injuries. The San Joaquin County Coroner’s Office has identified the decedent as 38-year-old John Alonzo Jr. of Manteca.

Loss of a Loved One in a Manteca Motorcycle Accident

The loss of a loved one is challenging for any family to experience. When the death was caused by the negligence of another, their grief may be compounded. Some may feel a sense of guilt from the thought that they could have prevented the accidental death somehow. Others may be devastated by their inability to tell their loved one how much they were appreciated and loved. In times like these, surviving family members need to ensure their basic needs are met to ensure they can cope with their loss without stress.

Does Insurance Cover Wrongful Death in a Motorcycle Accident?

The loss of a loved one often results in immense life changes, both financially and emotionally. If someone else is to blame for your loved one’s death, you and your family may be able to file a claim for wrongful death to recover economic and noneconomic damages. These include:

  • Costs of a funeral and burial
  • Expenses for medical care received by the deceased before he or she passed away
  • Loss of future financial support and benefits for the family
  • Loss of household services provided by the decedent
  • Loss of parental guidance and training
  • Loss of value to the estate of the decedent
  • Punitive damages are available in cases involving a conscious disregard of the safety of others, such as drunk driving or excessive speeding

Who Can File a Wrongful Death Claim in California?

In California, the immediate family of the decedent is eligible for wrongful death damages. This includes the decedent’s surviving spouse, domestic partner, or children. Any relatives who were financially dependent on the deceased may also be eligible for compensation, including putative spouses, stepchildren, parents, and children of the putative spouse. For a brief overview of who can file for wrongful death, watch the below video.

How Long Do You Have to File for Wrongful Death?

There are strict deadlines for filing a wrongful death claim. Under the California Code of Civil Procedure Section 335.1, a case for wrongful death must be filed within two years from the date of a loved one’s death. If a claim is not submitted within the deadline, the family may lose the right to recover compensation in court. To ensure your wrongful death claim is processed within the statute of limitations, it is best to seek the counsel of an experienced Manteca wrongful death lawyer.
