Mazda Recall for Loose Brake Calipers Risk

A recent safety recall has been issued by Mazda North American Operations (Mazda) for 24,037 vehicles for a risk of loose brake calipers. The issue was found in certain Mazda3 and CX-30 vehicles where the mounting bolts of the front brake calipers may not have been tightened properly during the assembling process. This may potentially allow the front brake calipers to loosen and lead to reduced braking performance or interference with wheel rotation, affecting overall handling of the vehicle. Either of these scenarios may lead to the increased risk of a car accident.

Owners will be notified by Mazda if their vehicle is affected by Mazda recall number 4420F. Dealers will perform inspections of the front brake caliper bolts and tighten them as needed. The affected brake caliper will be replaced if the bolts are missing. Any of these remedies for brake failure will be provided at no charge to owners.

Which Mazda CX-30 and Mazda3 Vehicles are Affected by the Loose Brake Calipers Recall?

Common Types of Auto Products Liability Cases

There are multiple ways an automotive products liability case can arise. In some cases, the vehicle in question may have been designed improperly. In others, the design of the car may have been correct, but the vehicle defect may have happened during the manufacturing process. Another potential issue is that the car was designed and manufactured in accordance with federal safety guidelines but failed to provide instruction or warnings about specific hazards. Any of these safety concerns may raise the legal issue of auto products liability.

Types of Recoverable Damages in a Products Liability Case

Through an auto products liability case, you may be able to recover financial compensation for economic and non-economic damages, such as:

  • Past and future medical care and bills for injuries related to the use of a defective product
  • Lost wages for time missed at work to recover from a defective vehicle crash
  • Lost future earning capacity due to permanent injury or disability suffered as a result of an accident
  • Loss of consortium for the damage an accident injury has had on a marital relationship
  • Pain and suffering for the emotional suffering and physical pain caused by an accident-related injury
  • Punitive damages may also be recovered from the automaker if their conduct was so egregious that the courts want to ensure that the company and others will never engage in such behavior ever again

What is the Statute of Limitations for California Products Liability Cases?

There is a specific amount of time in which an automotive products liability lawsuit must be filed by. This is called the statute of limitations which starts on the date of injury or when it should have been discovered. In California, a personal injury lawsuit must be filed within two years. This is by the California Code of Civil Procedure Section 335.1. If a case is not brought within the deadline, the court may dismiss the case no matter how well founded it is. Because of these issues, it is essential to contact a California personal injury attorney as soon as possible. A lawyer can work to ensure all filing criteria and deadlines are met in your case so you can focus on what matters most: your recovery and your family.
