Pedestrian Accidents and Wrongful Death
Losing a loved one in a pedestrian accident is difficult but even more so when the incident was caused by a negligent driver. When this happens, a family can turn to a wrongful death lawsuit to recover financial assistance provided by the decedent, end of life expenses, and other monetary damages. While no amount of money can bring a loved one back, it may help lessen the financial burden the untimely death caused. To learn more about these types of cases, watch the following YouTube video:
What Can Be Recovered in a Wrongful Death Claim?
Following are the main areas of recovery in a wrongful death claim:
- Benefits that were lost, including health insurance and pension.
- Cost of household services provided by a loved one such as childcare and lawn maintenance.
- Expenses for a decedent’s funeral and burial.
- Future wages a decedent would have earned for his or her family had the accident not occurred.
- Medical expenses for the deceased before his or her passing.
- Loss of consortium, in the case of a spouse or domestic partner.
- Loss of support, guidance, companionship, and affection.
Recourse in Hit and Run Accidents
When a pedestrian is injured or killed in a hit and run accident, the victim or family members of the decedent may seek recourse with their own automobile insurance policy. Medical expenses, time away from work, costs of a loved one’s funeral and burial, and other accident-related costs may be covered by a victim’s uninsured motorist insurance (UM) policy. If the victim does not have a UM policy of their own, but someone else in their household has such insurance, coverage may be extended to them. Contact an experienced attorney for more details.
