How Do I Deal with an Insurance Adjuster After a Minor Injury Crash in Stockton?

One of the most challenging aspects after a traffic collision is dealing with the other driver’s insurance company. Within a few days of a car crash, you may be contacted by an insurance adjuster whose job is to protect the best interests of their company. As such, they are trained to minimize the value of a personal injury claim or deny it altogether. If you receive any paperwork from the insurer or asked for a recorded statement, politely decline until you have consulted with an experienced Stockton car accident lawyer who can best explain what rights you have after a car accident. For more information on whether you can trust an insurer to offer you a fair settlement, watch the video below.

How Is Compensation Calculated for a Personal Injury Case?

The value of a personal injury case will depend upon a wide array of factors. These generally include the severity of damage to the vehicle, the extent of the injuries, and how the trauma has impacted the injured person’s life. An injury lawyer can gather all medical and work records and consult with experts to seek fair compensation, including:

  • Costs of past and future medical treatment
  • Emotional distress and mental anguish
  • Loss of consortium
  • Lost wages and future earning potential
  • Pain and suffering
  • Permanent scarring or disfigurement
  • Punitive damages may be available in cases where the at-fault party was involved in egregious conduct (e.g., driving under the influence or excessive speeding)

What is the Statute of Limitations on a Personal Injury Case in California?

There is a time limit you must follow when filing a personal injury claim in California. This deadline is known as the statute of limitations, which is two years for personal injury cases under the California Code of Civil Procedure Section 335.1. If a lawsuit is not filed within this time window, the court may dismiss the case, and the injured person may lose the right to recover compensation for their injuries and damages.
