Losing a family member is always a difficult experience, but when that death results from someone else’s negligence, it can be especially devastating. When you lose a loved one due to someone else’s careless or illegal actions, you may be able to file a wrongful death lawsuit. These types of lawsuits are designed to hold the at-fault party accountable and to help the surviving family members recover damages.
Wrongful death lawsuits can be complex, so it is important to consult with an experienced attorney. The knowledgeable wrongful death lawyers at our firm can evaluate your case and help you pursue the compensation you deserve.
Recovering Damages in a Wrongful Death Claim
Losing a loved one who was a bicycle rider who enjoyed the outdoors is always a tragedy. But when their death was caused by someone else’s negligence, it can be especially difficult to cope. If you’re struggling to make ends meet after the wrongful death of a family member, you may be considering filing a claim.
Economic and Non-Economic Losses
Calculating your economic and non-economic losses can be a difficult task, especially if you’re still grieving. But it’s important to get an accurate estimate of your damages so you can get the compensation you deserve, and that’s where your accident attorney can help. Here are some of the economic damages you may be able to recover in a wrongful death claim:
- Loss of earnings: If your loved one was the primary breadwinner in your family, their death could cause a significant loss of income. You might be able to recover their lost wages, as well as any future earnings if they had not died.
- Loss of benefits: In addition to lost wages, you may also be able to recover the loss of benefits such as health insurance and retirement savings.
- Funeral and burial expenses: You also might be able to recover the costs of your loved one’s funeral and burial expenses. This can be a significant expense, especially if you have to make last-minute arrangements.
- Loss of companionship: This is a non-economic damage that can be difficult to quantify. But if your loved one’s death has caused you to suffer from loss of consortium, emotional distress, depression or anxiety, you may be able to recover damages for these losses.
