How a Motorcycle Collision at an Intersection Occurs
According to the National Highway Traffic Safety Administration, about half of all motorcycle accidents happen at intersections. Most of them involve a motor vehicle. Ninety percent of these collisions result in injuries to the motorcyclist, and 45 percent cause severe trauma.
Many of these crashes are due to negligence on the part of the motor vehicle operator, but motorcyclists have rights just as others using the roadway do. Some of the primary reasons for a motorcycle collision at an intersection include:
- Motorists are not careful to look for motorcyclists before moving out into an intersection.
- The rider is in a motorist’s blind spot because the vehicle driver’s vision is obscured.
- The motorist was distracted by texting, talking to a passenger, or looking at GPS.
- The vehicle driver was speeding and could not stop in time to prevent a motorcycle collision.
- The traffic light was malfunctioning, and both individuals thought it was safe to pass through the intersection.
- The motorist was fatigued and not concentrating well on the surrounding traffic.
- Sun glare or other weather conditions affected the driver’s ability to see well.
- The driver had been using drugs or was drunk.
Investigation of a Motorcycle Collision
A motorcycle collision is investigated much in the same way as any other traffic accident. However, one exception is that the bike is checked carefully to ensure a defect did not cause the motorcycle crash. Our investigators are experienced in rooting out the cause of an accident, and this helps our clients obtain compensation to pay their medical expenses and lost wages, as well as for pain and suffering. Other areas that are checked for evidence to support a client’s case include:
- Investigators perform forensic reconstruction of the accident, which can determine exactly how it occurred and help to show fault.
- They review the report by the police, look for mistakes, and talk to witnesses to understand what they saw.
- The investigators search for traffic or business surveillance cameras that may have captured the accident on tape. Those can be subpoenaed.
- Since government negligence may have been a factor in the crash, the investigators looked for signs of poor maintenance. This may include a malfunctioning or poorly timed traffic signal, foliage overhanging a sign, or potholes and fissures in the pavement.
