Details on the Motorcycle Crash Fatality in Los Banos

A preliminary release revealed that a man, age 71, was riding a 2005 Yamaha motorcycle eastbound on State Route 152. The motorcyclist was in the No. 1 Lane of eastbound SR-152 at the time of the incident, officials said.

For unknown reasons, the biker allegedly lost control, struck a guardrail, and suffered fatal injuries. Officials have not yet released the identity of the decedent due to pending notification of relatives. An investigation into the motorcycle crash fatality in Los Banos is ongoing by CHP traffic officers.

Who Can Be Held Liable for a Fatal Motorcycle Accident?

Collisions involving motorcyclists tend to result in severe injury or even death to those involved due to a biker’s lack of physical protection. Many motorcycle crashes occur in and around Merced County for a wide array of reasons. These may include but are not limited to:

  • Faulty Bike Parts: Defective parts and equipment may create factors that put motorcyclists at risk of crashes. When faulty bike parts are suspected to be the cause of a catastrophic motorcycle collision, it is essential to preserve the bike until it has been examined by an attorney and their team of experts. An injury lawyer will work to determine if defective motorcycle parts contributed to a wreck and if the claimant has grounds for a products liability claim against the manufacturer and other parties.
  • Unsafe Road Conditions: Dangerous roads may contribute to a serious or fatal motorcycle accident. Government entities are expected to design public roadways that are safe and maintain them as such. When a public agency fails to do so, and a severe crash occurs, they may be held liable for the resulting damages. The two-year statute of limitations is decreased in these cases to six months. This is by the California Government Code Section 911.2.
  • Hit-and-Run Drivers: Fleeing motorists can cause harm to drivers and others on the road, including bikers. When a motorcyclist is injured in a crash caused by a hit-and-run driver, they may be left with serious injury. In some extreme cases, it may deprive a family of a loved one. An independent investigation by an attorney with the resources to work with a private investigator is necessary. A lawyer can track down the fleeing motorist and hold them accountable for the harm their actions have caused.
