Things Survivors Should Know About Wrongful Death Motorcycle Accident Cases
When a loved one is lost in a vehicle versus motorcycle crash, the family of the decedent may file a claim against the negligent driver and their insurance company. While no amount of compensation may undo the grief and pain caused by the sudden loss of a close relative, a wrongful death case may reimburse survivors for economic and non-economic damages incurred. This may provide a sense of justice and closure for surviving family members and help them move forward.
Eligible survivors may be compensated for the loss of companionship, loss of benefits, loss of financial support the decedent would have provided to the household, medical bills associated with the loved one’s final injury, costs of funeral and burial services, mental anguish, and more. The statute of limitations is a time limit that is set for filing a case in court. For wrongful death matters, a two-year deadline is generally applicable, with few exceptions.
An experienced wrongful death attorney in Oakley can review the facts and circumstances of your claim to determine the appropriate statute of limitations that applies to your case. If a lawsuit is filed after the statute has expired, it will most likely be dismissed by the court. When that occurs, surviving family members may lose the right to seek damages from at-fault parties. To protect your right to financial recovery, it is essential to retain legal counsel immediately.
Importance of Working with an Attorney on a Wrongful Death Case
The insurance company representing the other side may not have the best interests of surviving family members at heart. The insurer may be concerned with protecting their bottom line instead of fairly compensating survivors for what they have been through. Therefore, it is recommended to retain legal counsel immediately following a motorcycle crash.
