How a Wrongful Death Action Can Help Survivors

The loss of a close relative is never easy. It may be even more painful and devastating when another party’s carelessness or negligence contributed to the loss of life. Understandably, the grief experienced by surviving family members may turn to frustration and anger when this is the case. Survivors affected by such a situation may have the right to bring a wrongful death claim against the at-fault party. This will be based on the facts and circumstances involved. Damages in these cases are intended to provide compensation to surviving family members for intangible harm and financial losses.

Some of the most common recoverable losses in a wrongful death action in California include loss of guidance, advice, comfort, and companionship, mental anguish, funeral costs, loss of reasonably expected income, and medical bills (through a survival action). While no amount of money can put a value on a lost loved one’s life nor bring them back, filing a case against the at-fault party is essential in the grieving process. It may provide closure for surviving family members in that the other side has been held accountable for their actions.

To bring a successful case of wrongful death forward, it must be proven that the at-fault party was careless or negligent. An experienced California wrongful death lawyer can help survivors by collecting and preserving the necessary evidence to demonstrate the other side’s actions. Based on the facts and circumstances involved, an attorney may need to conduct an independent investigation, request documents, speak with witnesses, and more. Some cases may require experts who can provide testimony on specific facts of the matter.
