What Injured Parties Should Know About Motorcycle Accident Cases
The roads in Stanislaus County and across California provide some of the most scenic views and thrilling rides for motorcyclists. However, riding a motorcycle in the golden state may come with its unique dangers. That is because too many drivers of motor vehicles fail to share the road with others in a safe manner, including bikers. When this happens, it is often the motorcyclist who is left behind with traumatic injuries that may result in mounting medical bills, wage loss, and other damages. Bikers do not enjoy the same protection that a motor vehicle provides, such as a steel frame and seat belts. For this reason, it is common for motorcycle riders to suffer some of the most catastrophic injuries on the spectrum. This may include internal trauma, bone fractures, traumatic brain injuries, spinal cord injuries, and more. Immediately after a crash, it is essential for an injured biker to get evaluated at the hospital and have their trauma documented by physicians immediately. Injured parties should also follow up with their primary doctor and follow their physician’s recommendations for treatment.
To bring a strong personal injury case for compensation after a motorcycle accident, clear and compelling evidence must be presented that demonstrates negligence on the part of the other party. Even when liability is clear, an injured motorcyclist should be prepared for the unexpected when it comes to dealing with insurance companies. That is because insurers are in the business of protecting their profit margins by paying as little as possible on bodily injury claims. In motorcycle accident cases, it is not uncommon for insurance carriers to attempt to shift blame onto the claimant as a way of limiting financial liability for the crash. If the other side is unwilling to treat an injured biker fairly or provide them with the fair financial compensation that they need to put the collision behind them, an experienced motorcycle accident attorney will step in and ensure that the rights of their client are protected throughout the process. Importance of Hiring an Attorney After a Motorcycle Crash
In the time following a motorcycle accident, an adjuster from the other party’s insurance company may reach out to an injured biker for a recorded statement or offer a settlement. It is crucial for injured parties to understand that their words in a recorded statement may be used against them later in the personal injury claims process. Conversely, an initial settlement offer from the insurer will be far lower than what they need to cover medical bills, time away from work, and other losses.
