Traffic Crash on Highway 65 Results in Death of Motorcyclist

A motorcyclist riding a Yamaha was killed in a traffic crash on the highway close to Lincoln, north of Roseville, on August 11. The accident happened at Highway 65 and Nelson Lane at about 5:39 p.m. The motorcyclist, age 27, died as a result of the accident.

Traffic Crash Reportedly Occurred When Motorcyclist Ran a Red Light

The other vehicle driver suffered pain but was not transported to the hospital. The California Highway Patrol (CHP) responding officers said the motorcyclist went through a red light attempting a left turn when he was struck by a Lexus going west along Nelson Lane. Videotape evidence and witnesses verified that statement.

Accident Being Investigated to Corroborate Witness Statements and Video

The motorcycle rider was transported to Roseville Sutter Medical Center where he was declared deceased. The cause of the accident will be investigated by CHP traffic detectives to determine fault in the collision. The deceased motorcyclist’s name won’t be released until the County Coroner has notified his family.

When Can You Place a Wrongful Death Claim in a Fatality Accident?

When your loved one died in an accident and the other driver or entity was negligent and caused it, the family can file a wrongful death claim. Although family members are grieving their loss, they often realize that their finances will be stressed by the cost of end-of-life expenses and lost income the decedent provided. Those losses can be recovered, as well as other damages, by filing a lawsuit.

Recovering Compensation in a Wrongful Death Traffic Crash

The surviving spouse and children of a person killed in a wrongful death traffic crash can file a claim to recover damages. The amount depends on a number of factors, such as the person’s earnings and age, but generally, the following can be recovered:

  • If the deceased loved one was employed, their earnings and other perks they received in their job (bonuses, tips and more) are recoverable until they would have reached retirement age.
  • The expenses for the funeral and burial or cremation are recovered.
  • The spouse can recover damages for his/her pain and suffering, such as loss of consortium, emotional support, etc.
  • The family’s children may claim compensation for the loss of their parent’s love, affection and nurturing.
  • The value of household services the decedent performed around the home are recoverable.

Help from a Wrongful Death Lawyer

A wrongful death lawyer’s job is to help the family recover compensation for their loss. The lawyer can explain and guide them through the process, gather the evidence to prove fault and calculate the damages. The family then can know they are being taken care of, which helps remove the financial burden they may be facing.
