What You Should Know About Auto Accident Cases and Insurance Companies

If another driver has injured you, it is essential to understand your rights and options for recovery. Under California law, all motorists are required to operate their vehicles safely and exercise due care to others on the road. When a driver fails to do so, they may be held liable for resulting injuries and losses. While we would expect all motorists to carry liability coverage, not all drivers have a valid insurance policy. Conversely, drivers may carry state minimum insurance limits that may not be able to cover economic and non-economic damages resulting from serious injuries. In a multi-vehicle accident case, this may leave injured parties in a financial predicament and a whirlwind of stress if it has been determined that the at-fault party has insufficient to no auto insurance.

A party that has been injured in a motor vehicle collision caused by a driver with little to no liability coverage may depend on their insurance policy to step in to pay for damages incurred. This is possible so long as they have uninsured and underinsured motorist coverage (UM and UIM). For a multi-vehicle accident caused by a motorist with insufficient or no liability coverage, an injured party may bring a UM or UIM claim to fully cover or supplement the resulting losses.

Insurers often reach out to injured parties right away following a motor vehicle collision. They may request a recorded statement or make a quick settlement in hopes of the claimant accepting. An injured party may be persuaded into agreeing to the insurance settlement to help pay for medical bills, lost income, and other losses in connection to the incident. The unfortunate reality is that any initial settlement offer, including one from your insurer, will be far less than what a claimant deserves. This is especially true in the case of traumatic injuries. That is why it is recommended to consult an experienced accident attorney following a crash to avoid falling for any of the defense tactics insurance companies may use to get out of paying a bodily injury claim.
