Fatality Accident With Multiple Injuries Reported on I-80

A fatality accident near Davis that also involved multiple injuries occurred on September 24. The crash was reported on eastbound Interstate 80 near the Richards Boulevard off-ramp just after 10:00 p.m. A report of the collision released by the California Highway Patrol (CHP) said that a vehicle was going fast along eastbound I-80 when another vehicle entered its path in a lane change.

Speeding Car Involved in Rear-End Fatality Accident

The car that was speeding struck the vehicle in its left rear. A passenger in the vehicle that was struck was not using seat restraints and was ejected, suffering fatal injuries. Four others suffered injuries ranging from moderate to minor in the crash.

Intoxication Not Involved in Fatality Accident

The CHP reported that alcohol was not involved in the cause of the collision. The CHP traffic accident unit is investigating to find out why the accident occurred.

When a fatality accident that includes injuries happens because of a negligent driver, the family of the deceased and those who suffered trauma may file claims to recover compensation. In the case of a fatality, the family has the right to file a wrongful death claim. Although the recovery of compensation will not ease their grief, it can help them avoid the financial problems that often accompany a sudden death.

Damages That Are Recoverable in a Wrongful Death

Once your lawyer has reviewed the case, the family can place a wrongful death claim if the deceased was not at fault. Recoverable damages may include the recovery of funeral and burial expenses, wages the deceased would have earned until retirement, compensation for the loss by the surviving spouse and children, and for household services.

Damages That Are Recoverable in a Personal Injury Claim

As in the above instance, another person or entity must have been at fault for the accident before an injured party can recover compensation in a personal injury claim. Recoverable damages may include:

  • Medical bills that arise from the individual’s injury can be recovered and include ambulance fees, physical therapy and rehabilitation. If the injury is still being treated at the time of the settlement, future expenses can be included.
  • Time at work that was lost because of the injury can be recovered, including any benefits that came with the job. If the injured person has to take a lesser paying position because their trauma will not permit them to return to their job, the pay difference is recovered also. When the injured person is permanently disabled, they can recover their wages until retirement age in a lump sum.
  • Pain and suffering, including both physical and emotional trauma. Around 25 percent of those who are injured in a collision develop post-traumatic stress disorder, which must be treated professionally. The cost of the treatment is recoverable.
