Folsom Boulevard Multiple-Vehicle Crash Causes Serious Injuries
A dump truck was involved in a multiple-vehicle crash in Sacramento on October 10, resulting in serious injuries. The accident involved four vehicles and occurred on Folsom Boulevard near Power Inn Road around 3:40 p.m. During the collision, the dump truck experienced a rollover and landed on top of one of the vehicles crushing it.
Multiple-Vehicle Crash Being Investigated to Determine Fault
Officers with the Sacramento Police Department reported the roadway was closed in both directions between Notre Dame Drive and Bicentennial Circle. The roadway remained shut down until around 8:00 p.m. At least two people suffered injuries in the accident, with one or more taken to a hospital with serious trauma. The accident is being investigated to determine how it occurred and to discover which driver/drivers were at fault.
Dump Trucks and Their Dangers
Dump trucks tend to tip over easily, especially if a driver takes a turn too fast. There are a number of reasons that makes them unstable, including their high center of gravity, shifting loads of gravel or sand and the weight of the cargo being hauled. Even driving on a slight slope is enough to cause a rollover.
Is the Driver’s Employer Liable for the Accident?
If the driver was negligent and caused the multiple-vehicle crash, they may be held financially responsible for injuries to others as well as other negligent drivers. However, most dump trucks are owned by a company that employs the driver. In certain instances, the employer may also be held responsible. In other instances, the company did not use its own employee to drive the truck but contracted out the work. It is possible to hold the company or any subcontractor responsible financially if any of the following types of negligence led to the injuries caused by the multiple-vehicle crash:
- The driver did not receive adequate training to handle a dump truck.
- The truck weight with cargo exceeded the legal limit.
- Inadequate safety inspections were performed, and the truck had problems with its tires, brakes or other parts that led to the accident.
- Unrealistic deadlines were placed on the driver that forced them to go at unsafe speeds.
- The driver attempted to turn a corner at too high a speed, which commonly makes a dump truck experience a rollover.
- The company insisted that the driver talks with dispatch or the customer or text while they are driving.
A Personal Injury Lawyer Can Help You Recover the Compensation You Deserve
Accidents involving commercial vehicles can be complex when it comes to finding out who all the responsible parties are. This is where an accident attorney can help. They can discover which parties are liable in your accident and investigate the case to recover the evidence needed to support your claim.
In addition to gathering your medical records and other losses, the lawyer calculates what you may receive in damages. They also negotiate on your behalf with the at-fault party’s insurance company to get the compensation that you deserve. If the insurance company refuses to provide fair compensation, the lawyer can take your case to court. You owe nothing unless your case has been concluded successfully.
