Negligent Driver Hits Man Changing Tire on I-5
A negligent driver caused an accident injury on June 6 when their vehicle struck a man changing a tire. The crash happened along northbound Interstate 5 just south of J Street at around 1:00 in the afternoon. According to the California Highway Patrol (CHP), a man along the right-hand side was changing his tire when another vehicle came along and struck him. A third vehicle came along and struck the second vehicle. Those injured in the accident were transported to a nearby hospital for treatment. The accident is under investigation by the CHP to determine how it occurred. At this time, there is no word as to whether drunk or drugged driving was involved.
Dangers of Changing a Tire by the Road
Many fatalities and traumatic injuries occur when a driver attempts to change their tire by the roadside. If possible, the best thing to do is to call AAA or another roadside service provider. It is important to stay inside the vehicle until help arrives. If you must leave the vehicle, stand at least five feet away on the far right side. Here are some other safety tips for changing your tire:
- Make sure your vehicle is on the shoulder. On occasion, a portion of the car will extend out onto the highway, increasing the chance of an accident caused by a negligent driver. If possible, choose a shoulder that is wide enough so that neither the vehicle nor the person changing the tire is at risk.
- Use warning lights: Aside from putting on your flashers and headlights, warning gear can easily be bought at most auto stores and online. Use triangles or other types of emergency lights to warn drivers that your vehicle has broken down.
- Call police: If a patrol car is in the vicinity, they can place their vehicle behind yours to warn other drivers there is a problem. Because of the number of accidents, police may not always be able to respond.
Recovering Compensation From a Car Accident Injury
One job of a personal injury lawyer is to obtain compensation for their clients following an accident caused by a negligent driver. Damages that can be recovered include the cost of all medical treatment, wages lost because the individual cannot work and pain and suffering. If the injury is expected to continue into the future, the cost of medical care and financial losses are recoverable too.
In some cases, the lawyer negotiates on your behalf with the insurance company to get the compensation you need. However, if negotiations are not successful, your attorney may decide that filing a lawsuit is the correct approach. If the defendant refuses his or her responsibility, the case may have to be brought to trial in a civil court. By investigating existing evidence and conducting their own investigation, a strong case can be built that proves the other person’s negligence and supports your claim.
