Losing a Loved One in a Wrongful Death

The loss of a loved one is always heartbreaking and difficult. However, it is so much worse when that Sacramento accident never had to happen. If a driver was negligent and caused the collision, the family may file a wrongful death claim to recover compensation. Although their grief will not be eased, by filing a claim, they can have the comfort that justice was achieved for the loss of their family member as well as recover compensation that might help them financially.

What Compensation Is Recoverable Following a Wrongful Death?

According to the facts of the case, wrongful death damages can vary. However, the following can usually be recovered:

  • Recoverable expenses include burial and funeral costs.
  • In addition to the decedent’s wages, the spouse and children who were supported by the decedent can recover their insurance benefits and pensions.
  • For the loss of guidance and nurturing provided by a parent, the family’s children can often seek compensation.
  • When a spouse suffers a loss of affection, love or consortium, compensation may be available.
  • Compensation may be sought for the value of household services provided by the deceased. Household services often include lawn and car care, handling the family finances and others. This is because the surviving spouse may have to pay someone else to perform those chores.

Why You Require the Help of an Injury Lawyer

The first thing a grieving family needs to do is contact a Sacramento accident attorney, so they can review the case and tell you whether you can file a claim. Second, the attorney will work to prove fault by the other party and investigate to gather the evidence that supports the claim. Third, the lawyer will calculate what compensation you might receive. Once that is complete, the lawyer will negotiate with the at-fault party’s insurance company to obtain a satisfactory amount of compensation.

The legal process can be confusing at first, but an experienced lawyer can walk you through it step-by-step. You can be sure that your rights are protected and receive the support you need during this difficult time if you have access to the right resources.
