Financial Recovery in Car Versus Pedestrian Accident Cases
Pedestrians are susceptible to serious injury or death on the road due to their complete vulnerability in a traffic accident. Individuals on foot do not have the same level of protection that motor vehicles offer. Therefore, pedestrians are kept out of harm’s way by the right-of-way, sidewalks, crosswalks, and traffic control devices. This is in an effort to maximize pedestrian safety. However, crashes between motor vehicles and pedestrians often occur from a careless or negligent motorists. This may be due to speeding, failure to yield the right-of-way to pedestrians, reckless driving, and other negligent driving behavior.
California law allows injured parties and families of lost loved ones to seek reimbursement for their damages through a personal injury claim or a wrongful death action. California accounts for both the financial hardship and intangible harm associated with a vehicle versus pedestrian crash. For personal injury, this may include wage loss, pain and suffering, medical bills, and more. Wrongful death claims may seek reimbursement for loss of companionship, mental anguish, funeral bills, lost earnings, and more. Claims for damages are generally brought against the at-fault party and their insurer.
As car versus pedestrian collisions often result in traumatic injuries or even death to the individuals on foot, it may be challenging for injured parties or families of decedents to fully recover while dealing with a claim for damages on their own. As such, it is essential to retain legal counsel immediately. A skilled and compassionate California pedestrian accident lawyer can handle all aspects of the case so an injured party or surviving family member can focus on rebuilding their lives.
