The Family Can File a Wrongful Death Claim

If a negligent driver or other entity causes a pedestrian fatality, the immediate family can file a wrongful death claim to recover damages. The parents or siblings may file if the deceased had no spouse or children. Recoverable compensation in a wrongful death claim generally includes the following:

  • The family may recover the deceased loved one’s funeral and burial expenses.
  • If the decedent was employed, they may recover his/her wages, pension and insurance, bonuses, and other job perks until they reached retirement age.
  • The surviving spouse/partner may recover compensation for their loss of consortium, affection, and moral support.
  • The family’s children may obtain compensation for their loss of parental guidance and nurturing.
  • Beneficiaries in the will may recover compensation in some cases.
  • If the deceased helped around the home regularly, the value of those services is recoverable since the family may have to pay for them in the future. Household services may include lawn and vehicle care, housework, cooking, and other tasks regularly performed.
