Pedestrian Fatality Near Stanislaus County

I’m Ed Smith, a Modesto car accident lawyer. A pedestrian accident occurred in an unincorporated area of Stanislaus County near Modesto on the night of Thursday, February 22, 2018. The accident, sadly, claimed the life of a man.

We would like to extend the friends and family of the man who passed away our sincere condolences.

What Happened?

A 19-year-old Modesto woman was driving her 2006 Toyota westbound along Whitmore Avenue in the vicinity of Carpenter Road at approximately 7:45 pm. The woman’s vehicle veered into the eastbound lane of travel as an attempt to overtake a 2007 Toyota driven by Stacey Martin, a 35-year-old Modesto woman. While the woman was overtaking Martin’s vehicle, she noticed a pedestrian in her path and moved her vehicle to the right to avoid the pedestrian. Unfortunately, her efforts were unsuccessful. The woman’s vehicle reportedly crashed into the pedestrian and collided with Martin’s vehicle. The impact of the collision caused both vehicles to lose control. Officials reported that Martin’s vehicle sustained major damage after crashing into a power pole in the collision.

Nature of Injuries

Paramedics were called to the scene to render aid to the victims involved. Martin and her two young passengers, a 5-year-old and a 12-year-old were all transported to the Memorial Medical Center in Modesto for treatment of traumatic injuries. The 19-year-old woman reportedly suffered minor injuries and was taken to the Kaiser Medical Center for treatment. Sadly, the pedestrian was pronounced deceased at the scene by responding paramedics.

Identity of Victim

The identity of the pedestrian has not been released to the public pending notification of next-of-kin.

What Caused the Accident?

A cause of the accident has not yet been determined by the California Highway Patrol (CHP). Usually, CHP investigators take one to two weeks to process a Traffic Collision Report. Traffic accident reports may sometimes be wrong or inconclusive relating to fault. A family of a deceased party may be left with many, unanswered questions as to how their loved one lost their life in the accident. Contacting an experienced wrongful death lawyer is crucial in pinpointing liability for a collision. Once liability has been properly determined, a wrongful death claim can be filed.

Losing Someone You Love

Losing a loved one in an accident is a devastating, painful experience. Even more so when the death was caused by the actions of a careless or negligent motorist.
