Recovering Compensation Following a Pedestrian Fatality Accident
After a pedestrian fatality accident caused by negligence, family members can seek financial compensation by filing a wrongful death lawsuit. The dependent recipients of the decedent’s support include his or her surviving spouse or putative spouse, children, or stepchildren who received at least one-half of their support from the person who died. There are various types of compensation available, including:
- Funeral and burial expenses can be recouped.
- The decedent’s future support, including pension and insurance benefits, can be recovered.
- A surviving spouse, putative spouse, or partner can obtain losses of consortium, moral support, comfort and affection.
- Loss of inheritance is recovered in some claims, which is the amount beneficiaries would have obtained had the decedent lived.
- Children who have been deprived of training, care and guidance by the decedent can recover those losses.
- In addition, the estate recovers losses associated with household services, such as lawn care and maintenance, and childcare.
- The family may be able to claim punitive damages in a survival action if the death was egregious or intentional. When a decedent lived for some time before dying, it is called a survival action.
