Accident on El Camino Avenue Injures Pedestrian

A pedestrian injury accident was reported in Sacramento on May 17 following a collision involving an SUV. The crash was reported by the California Highway Patrol (CHP) as occurring shortly after 3:00 p.m. along El Camino Avenue between Howe Avenue and Bell Street in the Arden-Arcade area. Sac Fire emergency responders were called to the scene, and it was determined that the pedestrian had suffered injuries. Additional data was not forthcoming at the time of this report. An investigation into the cause of the pedestrian injury accident is underway.

How a Lawyer Can Help Following a Pedestrian Injury Accident

Following a pedestrian accident, the injured person often ends up facing high medical bills, hospitalization, and time away from work in addition to their pain and suffering. Our injury attorneys have successfully handled many pedestrian injury claims over the years in obtaining the compensation they deserve. Recoverable Damages in a personal injury claim include:

  • All medical costs associated with the accident injury are recoverable. This ranges from the ambulance fee to hospitalization, physicians’ bills, prescriptions, tests, and surgeries to rehabilitation. Out-of-pocket expenses can be recovered also such as taxi fare to a doctor’s appointment.
  • Wages that are lost from the inability to work can be reimbursed, including any bonuses or additional perks of the job with a monetary value.
  • Lost earning capacity is recovered if the pedestrian injury accident makes it necessary for the person to take a lower-paying job afterward.
  • Loss of domestic services, which includes duties the person normally performed around the home such as mowing the lawn, childcare or servicing the vehicles.
  • Loss of consortium, which is the personal relationship between spouses, can be recovered.
  • If the accident was egregious or caused intentionally, the injured party may be able to obtain punitive damages. However, punitive damages are rarely awarded, and it’s important to ask your injury attorney about this.

Causes of a Pedestrian Accident

Pedestrians are among the most vulnerable when they are struck by a motor vehicle. The lack of protection afforded them instead of those inside a motor vehicle and surrounded by metal and protective devices make them vulnerable to severe injuries. Some of the reasons a pedestrian accident happens include:

  • A motorist is distracted because they are texting or talking on a cell phone and don’t see a pedestrian until it’s too late to avoid a collision.
  • The motorist has been drinking and, because of their lack of visual acuity and slowed reflexes, causes a pedestrian injury accident.
  • A driver is backing out of a parking space or driveway and fails to check for others who might be crossing behind the car.
  • The driver is speeding and cannot stop in time for a red light, so they run it instead. When someone on foot is crossing the street, it can end up causing a pedestrian injury accident.
  • The motorist is fatigued and has trouble concentrating on the road ahead. In some cases, a motorist nods off while driving, which can result in a pedestrian injury accident.
