Wrongful Death Claim After a Pedestrian Fatality
When a loved one dies because of a negligent driver, immediate family members may file a wrongful death claim. It won’t ease their grief and sense of loss, however, it can give the family a feeling that they are getting justice and a sense of closure. Some of the areas where compensation can be recovered include:
- The cost of the funeral and burial expenses
- Wages the deceased family member would have earned until their age of retirement, which includes pension, insurance, and other benefits
- The spouse can claim loss of consortium, moral support, affection and comfort
- Children in the family can claim the loss of guidance, care and training
- Loss of household services includes such areas as mowing the lawn, childcare and other duties performed previously by the decedent
- If the death was caused intentionally or in an especially egregious way, the family may be entitled to claim punitive damages through a survival action, which are meant to punish the wrongdoer
Why Should a Family File a Wrongful Death Claim?
Initially, it is difficult for the family to think of anything other than the fact their loved one is no longer with them. However, with time, it becomes clear that the loss of a supportive member of the family will have consequences. Aside from the financial difficulties that follow this loss, the absence of a family member who guided the family through all types of issues takes its toll.
In addition, the family’s anger over the unnecessary demise of their loved one makes it hard for them to reconcile. The family members need to find a way to achieve justice for the deceased, whose life was tragically taken. A wrongful death claim makes it clear that family members are holding the at-fault party responsible.
