Can You File a Claim for Damages From a Car Accident?
A variety of scenarios may lead to an injury or death caused by the negligence or carelessness of another party or entity. Individuals may get hurt or suffer fatal injuries when they are driving or riding as a passenger in a motor vehicle. After an injury, individuals may experience physical pain, emotional trauma, financial hardship from the car wreck, and unexpected losses. Surviving family members are often met with profound grief and sudden losses, like loss of financial support, loss of companionship, and more.
California law entitles those who have been injured or families who have been deprived of loved ones in accidents caused by negligent parties to seek damages in civil cases. When an attorney is retained for a personal injury or wrongful death claim, they will guide their client throughout the entire legal process to provide them the best chances of a successful result in their case. A reputable and qualified California personal injury attorney will review and evaluate a case in a free consultation. From there, the lawyer will determine the best course of action moving forward.
The best part about having legal counsel is being able to focus on recovery while the attorney handles an independent investigation, determination of damages, communicating with insurers, and negotiating for a favorable settlement agreement. A client can depend on their attorney to have their best interests at heart every step of the way. Who Can Be Held Liable for a Rollover Collision?
Aside from the motorist of the vehicle that was involved in a rollover accident, other parties may be held liable for damages. Driver error is not always the reason for rollovers. Some cases may involve faulty vehicle equipment wherein the vehicle manufacturer may bear liability for the incident due to a defect in design or manufacturing. Clear and compelling evidence in a products liability claim must demonstrate that the defect made it unreasonably dangerous to the vehicle occupants.
A government entity may be held liable for damages in a rollover collision due to unsafe roadway design or insufficient road maintenance. The statute of limitations, which is generally two years for personal injury and wrongful death, is shortened in cases against public agencies. A six-month deadline applies, according to the California Government Code Section 911.2. It is crucial that injured parties and survivors retain legal counsel right away to ensure that their case is handled appropriately and filed on time.
