Bicyclist Struck by Motorist at Cottage Way Intersection

An alleged hit-and-run with injuries occurred on June 23 involving a bicycle rider and motor vehicle in Sacramento. The collision occurred in the Arden-Arcade area at the intersection of Cottage Way and Wright Street around 8:40 p.m. The report issued by the California Highway Patrol (CHP) stated that the reporting person said there was damage to the vehicle. They stopped but did not feel safe there and left to report the incident. An investigation is underway by the CHP into what happened.

Accidents Involving a Bicycle and Its Major Causes

A bicycle accident could be the result of a rider’s error, but drivers of cars and trucks are also to blame. Each year, numerous motor vehicle accidents are caused by driver negligence, and many of these crashes are hit-and-run. Examples include the following:

  • A driver ignores the cyclist’s right of way when moving too close to the bicyclist, causing a serious accident. The law in California requires that motorists maintain three feet between themselves and bicyclists.
  • While making a right-hand turn, the driver fails to look for the biker in the bike lane and cuts them off.
  • A person riding a bike on the street is rear-ended by a car or stops short in front of it, and the rider is thrown from their bike.
  • At the same time as a bicyclist is crossing at an intersection, a motorist runs a red light. Accidents involving bicyclists are common due to this driver error.
  • Riders are bicycling down a street when a driver opens his car door without looking first for oncoming riders. Known as dooring, these accidents can cause serious injuries to bicyclists.

Identifying Hit-and-Run Drivers

Despite the fact that it is more common today to be in an accident when a driver flees the scene, many of them are still able to be found. A number of these hit-and-run drivers have been tracked down by our law office, and their negligent behavior has been held accountable. A person injured in an accident can seek compensation for medical expenses, pain and suffering, and lost wages by locating the driver. We use the following methods to locate the driver of the fleeing vehicle:

  • During the investigation, the investigators examine the film footage from business and traffic cameras.
  • In addition to taking a description of the car, driver and license plate number, witnesses are interviewed to determine if anyone took a video of the accident.
  • An investigator reviews the police report for errors and discovers what information they have gathered about the hit-and-run driver.
  • The process of accident reconstruction includes taking photos of the scene as well as looking for paint and metal pieces from the vehicle that can be matched to identify it.

If the Hit and Run Driver Isn’t Found, What Happens?

Uninsured/underinsured motorist coverage can be used when the negligent motorist cannot be located. Anyone in California who purchases auto insurance has the option to buy this add-on. Besides auto collisions, this add-on also covers injuries sustained by bicyclists and pedestrians. A household member’s policy can cover the cost if the injured party does not have insurance. Rates remain unchanged.
