Hit-and-Run Collisions
Our legal office has a good record of locating fleeing drivers. In addition to working with local authorities, we conduct our own investigation to locate that driver. We believe that it’s bad enough to be injured in a traffic accident. The injured person should not have to face the financial consequences in addition to the physical ones. By filing a lawsuit against the driver or dealing with their insurance provider, an injured person can obtain compensation to pay their medical costs, lost wages, and other losses.
Accident Causes Between Two Vehicles
Two-vehicle collisions are the most common, and there are a number of ways they can occur. Most accidents are caused by driver negligence. Some are as follows:
- A driver is speeding and cannot slow down in time to avoid a crash.
- The motorist makes a risky turn in front of oncoming traffic.
- The driver is distracted and fails to stop in time to avoid an intersection collision.
- A motorist is driving recklessly by tailgating, cutting in and out of traffic and failing to use their turn signal.
- The driver is drunk or impaired by drug use.
When a Fleeing Driver Cannot Be Located
Another option for an injured person to obtain compensation following an accident injury is through their uninsured/underinsured motorist coverage. This type of policy can be used not only for motorists and their passengers but if a household member is injured on a motorcycle, bicycle or on foot.
Uninsured/underinsured coverage is offered to all drivers when they obtain motor vehicle insurance, and many decide to take it. This is because there are a high number of motorists in the state who either have no car insurance or are underinsured. If the injured person does not have this add-on to their policy, they can use that of another household member without penalty. The insurance rate remains unaffected.
Investigation of an Accident
Evidence collection is needed to support a client’s injury claim. However, our office has a great deal of experience doing that. We send our investigative team to the hit-and-run site right away where our investigators:
- Look for evidence left behind by the hit-and-run driver
- Interview witnesses for corroborative statements and any information on the fleeing driver
- Check the police report for errors
- Perform forensic reconstruction of the hit-and-run accident, which can indicate how the collision occurred
- Check cameras in the vicinity for film footage of the hit-and-run
- Check for signs of government negligence such as potholes or malfunctioning lights that might have caused the crash
