Motorcycle Accidents With Motor Vehicles
In a collision involving a motorcycle and motor vehicle, the rider can face serious injuries or suffer a fatality. Even though most motorcyclists are cautious because they understand the dangers that surround them, they can’t always avoid a collision. Drivers of passenger vehicles tend to keep their eye out for other similar motorists. They don’t always look for others in their path, such as motorcyclists, bicycle riders, or pedestrians.
Placing a Claim for Wrongful Death Following a Fatality Accident
At AutoAccident.com, our injury lawyers have been successful many times in obtaining fair compensation for a grieving family following a motorcycle fatality accident. We investigate the fatal collision to collect evidence to support the family’s claim, calculate the damages and deal with the insurance company for you to help you get the maximum compensation. If the insurance company will not pay what you deserve in your wrongful death claim, the case can be taken to civil court, and the evidence in the case can be used there.
Who Can File for Wrongful Death
Members of the immediate family of the deceased may file a wrongful death claim if negligence cost the life of their loved one in a motorcycle fatality accident. This includes the spouse and children in the family, whether natural or adopted. Stepchildren who obtained at least half their support from the decedent may file also. If one or more of the decedent’s offspring has died but has children, they may join the lawsuit. The administrator of the estate may file instead, however, only one claim may be made. If the decedent had no immediate family, the parents and siblings may file.
Recoverable Damages in a Fatality Accident
Damages that can be recovered after a motorcycle fatality accident depends on a number of factors, including the decedent’s age. However, the family may be entitled to recover the following:
- Expenses for the decedent’s funeral and burial
- Recovery of wages the deceased would have earned until his/her retirement age, including benefits they received
- The spouse may recover damages for loss of consortium, love and affection
- The loss of nurturing and guidance may be recovered by children in the family
- Loss of household assistance may be claimed
- In some instances, loss of inheritance can be recovered
