Sacramento Motorist Death Occurs in Two-Vehicle Accident
A Sacramento motorist death occurred on January 4 in a major two-vehicle accident on Elder Creek Road. According to the police report, the accident occurred between Sun River Drive and Logan Street at about 7:30 in the morning in South Sacramento. Details about the Sacramento motorist death were not supplied. The Sacramento Police Department will be handling an investigation into the cause of the accident. It is not thought that alcohol was a factor. I would like to extend my sympathy and prayers to those who lost their loved one in these difficult times.
Recovery of Damages Due to a Wrongful Death
A duty of care must be taken by motorists to prevent injuries to others. However, a Sacramento motorist death is common. When a motorist or other entity fails in their duty of care because of negligence and a loved one dies, the family can claim fair compensation for their loss with the help of a lawyer who is experienced in handling wrongful death cases. Recoverable damages in a wrongful death include:
- Loss of income, which includes future earnings the decedent would have received
- Loss of moral support, comfort, and companionship
- Loss of consortium if a spouse or partner is involved
- Funeral and burial expenses
- Loss of household services such as lawn or motor vehicle care, housework, and childcare
- Loss of parental care such as guidance and training
- Punitive damages if a loved one’s death was an intentional act such as a homicide
- Medical costs if a loved one lived for a time before expiring, which is referred to as a survival action
Providing Proof in a Sacramento Motorist Death
There are four criteria in the burden of proof that must be met in order to make a claim for wrongful death. A personal injury lawyer can help meet those criteria, so that a claim can be filed for financial compensation. The requirements are:
- Proof that an individual or entity held a duty of care to act in a reasonable manner to prevent injuries or the death of another individual.
- Proof that an individual or entity failed in that duty. In the case of a motorist, this can be that the motorist ran a red light, was driving drunk or committing some other act of negligence. In the case of a government entity such as the county or state, that adequate protections were not in place to prevent a death.
- Proof that had the negligence not occurred, the individual would not have died.
- Proof that the family suffered a financial loss because of the demise of their loved one.
