Elsie Avenue Motor Vehicle Crash Causes Pedestrian Fatality

A pedestrian fatality was reported by authorities in Sacramento on August 10 after the individual was struck by a motor vehicle. The collision occurred along eastbound Elsie Avenue just east of Stockton Boulevard around 9:25 p.m. The California Highway Patrol (CHP) reported that Sacramento Fire Department emergency responders and the County Coroner for Sacramento were called to the scene where the pedestrian was declared dead.

Accident Fatality Being Investigated

No description of the vehicle that caused the pedestrian fatality was provided. The CHP is investigating the accident to determine how it happened. The name of the deceased has not been released yet, pending the notification of the family.

Pedestrian Deaths in the Country Jump Up

According to the Governors Highway Safety Association, the number of pedestrian fatalities versus the number of miles driven in 2020 rose an astonishing 21 percent from the previous year. This increase is despite drivers going out much less during 2020 due to the pandemic. California has among the highest number of pedestrian deaths in the country. Their statistics point out that:

  • 75 percent of pedestrian fatalities occurred after dark.
  • 74 percent happened outside an intersection.
  • 63 percent of the pedestrian fatalities occurred on an arterial road.
  • The majority are killed in a collision involving a passenger vehicle, not a truck, SUV, van, or bus.

Ways to Decrease the Risk of a Pedestrian Accident

Intoxication is a major cause of pedestrian accidents, both by the person on foot and by the driver of the vehicle. However, the following measures are recommended by the GHSA, which they believe will significantly lower the number of pedestrian fatalities. These recommendations include:

  • Routinely design and build right of ways that are safe for all users.
  • Encourage the purchase of vehicles equipped with automatic braking systems.
  • Increase the timing on yellow and red traffic signals to enable walkers and those on bicycles to cross safely.

Recovering Compensation After the Death of a Loved One

When a loved one is lost due to a pedestrian accident caused by a negligent driver, the immediate family members may band together to file for wrongful death. Of course, it does not ease their sense of grief and anger, but it does recover their financial loss and give them a sense of justice. Some of the areas in which damages can be claimed include:

  • The wages lost by the loved one until their age of retirement can be recovered. This includes pension benefits, bonuses, insurance coverage, and other perks of the job.
  • The surviving spouse may claim loss of consortium, moral support, and affection they received from the decedent.
  • The expenses for the funeral and burial are recoverable.
  • The family may claim loss of inheritance.
  • Children in the family, whether natural, adopted or stepchildren who received at least half their support from the decedent, may claim the loss of care, training and parental guidance the deceased provided.
  • Household services provided previously by the loved one are recoverable. This area includes tasks the loved one previously performed, from childcare to mowing the lawn and other gardening chores, taking care of the family vehicles, bill paying, and others.
