Two Injured in U.S. 50 Roadway Departure Accident at Shingle Springs

A Shingle Springs roadway departure accident occurred on October 20 when a vehicle went out of control and struck a guardrail in the center divider. The collision happened around 9:15 a.m. along westbound U.S. 50 just east of Cameron Park Drive in Shingle Springs. The California Highway Patrol (CHP) report said emergency medical personnel were called to the scene.

Medics transported two injured parties to Marshall Medical Center in Placerville. The condition of those who were injured has not been released. The vehicle was towed. An investigation by CHP traffic crash detectives is determining the cause of the collision.

Guardrails and Their Function in a Roadway Departure Accident

American Traffic Safety Services Association statistics show roadway departure crashes account for more than half of all collision fatalities. If correctly installed, guardrails absorb crash energy in head-on and angled impacts. Vehicles traveling at 62 mph are used in crashworthiness tests. A vehicle traveling at a higher speed when it impacts may cause the guardrail to malfunction. An injury lawyer can determine whether the guardrail was defective or improperly installed, which resulted in injuries or fatalities.

Additional Causes of a Run-Off-Road Accident

There are other reasons for a roadway departure accident other than negligence by the driver. These include the following:

  • Roadway maintenance neglect can cause a vehicle to leave the road and crash. Lack of maintenance may range from potholes and upheavals to poorly marked lanes and soft shoulders. If it is found that the road is in poor condition and caused the crash, the injured person may place a claim against the government entity responsible. The time limit to file such a claim is six months, much shorter than other personal injuries. Seeking assistance from an injury lawyer to ensure paperwork is submitted promptly may be recommended.
  • Defective auto parts are another cause of off-road accidents. Brakes that fail, an accelerator that sticks, tire blowout, or other defective parts can make the driver lose control, resulting in an injury accident. Retaining the vehicle following a single-vehicle crash is essential so an engineer can examine it. If a defect was the cause of the crash, an accident attorney can help you place an auto product liability claim against the designer of the part, manufacturer, and others.

If an accident lawyer determines that negligence by another entity or person caused an injury accident, the injured parties may file a claim to recover compensation. Compensation in this type of claim includes medical expenses, lost income from the inability to work, and pain and suffering. Additionally, the lawyer can negotiate on their behalf with the at-fault party’s insurer to help the injured party obtain the best outcome.
