Filing for Wrongful Death
The loss of a loved one in a single-vehicle crash is always devastating, but when the death is caused by someone else’s negligence, it can be especially difficult to cope with. A wrongful death claim is filed by the surviving family members of the deceased against the party who caused the death. To succeed in a wrongful death claim, the family must show that the fatality was caused by the negligent or wrongful act of another and that they have suffered damages as a result.
Filing a Personal Injury Lawsuit
If you are considering filing a personal injury lawsuit because you were injured in a single-vehicle crash, it is important to understand the different damages that may be available to you. There are two main damages that can be awarded in a personal injury case: economic/non-economic damages.
Non-Economic and Economic Damages
Non-economic damages reimburse the injured party for their intangible losses and include pain and suffering, emotional distress and loss of enjoyment of life. Economic damages provide compensation to the injured party for their financial losses. This can include medical expenses and lost wages. Even someone who is a passenger in the vehicle can file a claim.
