Vehicle Goes Off Road Into Babel Slough

A fatality accident was reported in Yolo County on March 24 when the vehicle ended up going off the roadway into a slough near Clarksburg. The accident report by the California Highway Patrol (CHP) said an SUV was found submerged in Babel Slough off Jefferson Boulevard at around 4:09 p.m. Although the driver was pulled out of the vehicle, that person perished at the accident scene.

Accident Being Investigated to Determine Why Driver Went Off Roadway

West Sacramento and Clarksburg fire departments responded to the site of the accident. No other occupants were in the SUV. A dog was removed from the vehicle and is under treatment. The roadway where the collision occurred remained closed while investigators determined how the accident happened.

Factors Contributing to a Single-Vehicle Fatality Accident

A single-vehicle fatality accident is usually caused by driver negligence or a mistake. It is possible for a driver to end up in a fatal accident for a number of reasons for which his or her family may be entitled to a wrongful death lawsuit. They include, but are not limited to:

  • Auto defects: Whenever an accident is caused by a defective auto part, the manufacturer and others on the production line are responsible. A vehicle should be retained so that defects can be found. If a defective product caused the accident, a lawsuit may be filed against the manufacturer by filing an auto products liability claim.
  • Government neglect: When poor road maintenance leads to a fatality, a government entity might be held responsible. Poor lighting at night, broken traffic signals or potholes on the road can cause a driver to lose control and end up in a single-vehicle accident fatality. The statute of limitations for bringing a lawsuit against a government entity also expires much sooner than other claims for personal injuries. A claim for government compensation has to be filed within six months from the date of the injury.  Other deadlines may also be required. You can rely on a personal injury lawyer to handle your claim and ensure that all paperwork is filed on time.
  • Hit-and-Run: When a driver flees the scene, it can appear as if there was a single-vehicle fatality accident. It is possible for an injury lawyer to investigate an accident to determine if another driver committed a hit-and-run and find the at-fault driver.

Claims for Wrongful Death in a Fatality Accident

Many of our clients have lost loved ones due to wrongful death. When losing a loved one, families often don’t consider filing a claim right away. Yet they may discover that the death will have a significant impact on their finances, particularly if it was the deceased who supported them.

Family members can receive justice for their loss and a sense of closure by filing a wrongful death claim in addition to recovering financial losses. Among other things, a wrongful death claim can compensate the surviving spouse and their children for the funeral and burial expenses, as well as the loved one’s lost wages until retirement age. While it won’t ease their grief, it can provide them with financial help going forward.
