Who is Responsible for a Pedestrian Accident?
Pedestrians and drivers have a responsibility to follow the rules of the road under California law. As such, both parties can be held financially accountable if they fail to do so. More often than not, motorists are liable for the injuries a pedestrian suffers in a traffic collision since speeding, drunk driving, and inattention are some of the top causes of pedestrian accidents. Those hurt in pedestrian accidents in Antioch may protect their legal rights to financial compensation by:
- Seeking immediate medical attention for any injuries suffered in the pedestrian accident and following all of the medical providers’ instructions to make a full recovery. Failing to follow instructions by your doctor may challenge the expected outcome and value of your personal injury claim.
- Keep track of any hours you miss at work and ask for a letter from your employer to show lost wages.
- Gather all evidence related to your accident and injuries. This may include eyewitness contact information, police reports, and more.
- Do not admit fault when discussing the pedestrian accident injury case with the insurance company. Do not agree to any recorded statement or sign any documents from the claims adjuster until you have spoken to an attorney.
- Retain an experienced Antioch personal injury lawyer to handle your case. An attorney can help look into all potential areas of recovery, including uninsured/underinsured motorist coverage (UM/UIM) on your policy or that of someone you love with, and obtain a fair recovery of your injuries and losses incurred.
