Accident on the Cap City Freeway Involves Motorcycle Rider and Semi
A traffic collision between a semi and motorcycle occurred on the northbound side of the Cap City Freeway on May 12. The accident was reported by the California Highway Patrol (CHP) at around 9:13 a.m., just south of the Howe Avenue exit ramp. At the time of this report, it is unknown if any injuries occurred. However, an EMT was examining the motorcycle rider.
Additional Information About the Traffic Collision
The accident left the number three lane on the freeway blocked by the motorcycle. Tow trucks were summoned to remove both the motorcycle and semi-trailer, which had a broken air line and locked brakes. The trailer was estimated to weigh around 30,000 pounds.
Traffic Collision Being Investigated by Authorities
A SigAlert was issued saying that the eastbound right-hand lane of Business 80 was blocked at Marconi Avenue. Motorists were advised to anticipate heavy delays, and no estimate was given for the road to reopen. The CHP will be investigating the traffic collision to determine fault.
How a Truck Accident Lawyer Helps
Our law firm has successfully handled many truck accident injury claims over the years. Because commercial trucks are governed by state and federal regulations and often involve multiple entities, accidents can be complex. The first thing we do is determine who is liable for the accident injuries.
Liability can range from the driver or company owner to the mechanic that serviced the truck and the person who loaded the trailer. Our investigators perform the following search for evidence that will support your claim, including:
- Our investigators examine maintenance records to see if repairs were performed and inspections made. Lack of proper maintenance and inspections provide evidence of fault if the driver was involved in an injury accident. If the driver was working for a trucking company or rented the big rig, those parties may be liable also.
- They perform accident reconstruction to determine how the traffic collision happened, which often points toward the at-fault party.
- The ELD or logbook in the big rig is checked to ensure the driver did not violate any of the driving or rest break regulations.
- Nearby surveillance cameras are examined to see if any of them captured the traffic collision on video. This type of compelling evidence is useful both when negotiating on your behalf with the insurance company and in court.
- Witnesses to the accident are interviewed. In some cases, the witness videotaped the traffic collision on their cell phone.
The compiled evidence is handed over to our able injury attorneys, who use it to construct a strong case that benefits our client.
Negligence Caused by a Big Rig
Although a big rig can be involved in an accident in the same way as a passenger vehicle, because of a semi’s large size and weight, a collision can produce much more serious injuries. Some accidents caused by big rigs include:
- Underride/override accidents are often caused when a truck stops suddenly or is speeding.
- Rollovers can impact nearby vehicles if they are close when a traffic collision occurs.
- Jackknife accidents can occur due to excessive speed, using the wrong brake, and in bad weather conditions.
- Blindspot collisions occur when another vehicle is pacing the truck driver.
- Accidents are caused by overloading or improperly loading the cargo.
- Wide turn accidents happen because a tractor-trailer requires more space and may swing into the next lane, colliding with another vehicle.
