What You Should Know About Truck Accidents
Big rigs are a common sight in Stockton and throughout California. Despite commuting a short distance to and from work or school, you are likely to see a large truck. While tractor-trailers are essential to our economy and responsible for transporting goods, they may also present inherent dangers on the roadway, particularly when the truck driver or trucking company has not followed state and federal safety regulations. When a semi-truck collision occurs, they often result in serious injuries or even death to occupants of smaller vehicles. As with any accident-related injury comes the potential for significant economic and non-economic damages. These may include medical bills, wage loss, pain and suffering, lost quality of life, and more.
Most big rig crashes are entirely preventable and occur as a result of negligence. This is the failure to exercise due care to others on the road. Examples of negligence that may lead to a truck accident may include distracted driving, failure to properly train a driver to operate a large truck, improper cargo loads that may shift in transit, speeding, drowsy driving, and failure to maintain a semi-truck in safe and operable condition. In addition to these, defects in a semi-truck, such as faulty tires and brakes, may also play a contributing factor to a wreck. When this is the case, an auto products liability claim may be brought against the manufacturer for damages incurred. Such cases require the vehicle in question to be kept and preserved for a Stockton truck accident lawyer and their team of experts to examine for potential defects.
Working with an experienced injury lawyer is essential in the claims process as an attorney will have the knowledge, skills, and resources necessary to conduct an independent investigation of the incident, send letters of preservation of evidence to the appropriate parties, work with experts in the field, communicate with the other side’s insurance company, and more. Since liability may fall on the shoulders of multiple parties, it is essential for an accident attorney to determine who was responsible for the incident when bringing forth a personal injury claim. Keep in mind that a two-year statute of limitations generally applies to accident cases under the California Code of Civil Procedure Section 335.1. Why Should You Hire an Attorney for a Truck Accident Case?
What many people may not know about getting injured in a truck crash is that the other side is often represented by insurance companies and defense counsel. Taking these entities alone may be challenging. Therefore, it is in your best interest to hire an experienced accident attorney that can level the playing field and work diligently to obtain a favorable outcome in your case. Unlike the insurer and defense counsel, your lawyer will have your needs, goals, and future in mind throughout the process and stop at nothing to recover the full and fair compensation you deserve.
