Two Fatality Crashes in San Joaquin County

The California Highway Patrol reported two separate fatality crashes in San Joaquin County on the morning of October 20, 2023. One collision occurred on Highway 120 in Manteca, and the other occurred on State Route 12 at SR-88 in Clements, officials said.

Details on the Two Fatality Crashes San Joaquin County

A preliminary release indicated that the first accident occurred shortly before 5:30 a.m. on SR-120 close to Airport Way in Manteca. The incident was described as a rollover collision involving one vehicle, a 2021 Toyota Camry. The vehicle allegedly veered off the north side of the roadway and overturned several times. Sadly, the driver of the involved vehicle suffered fatal injuries due to the crash.

A separate car wreck also occurred in San Joaquin County approximately 30 minutes after the initial crash. CHP traffic officers indicated that a small pickup truck and a gray Honda were involved in a collision. Two parties were taken to the hospital for injuries. Another individual was declared deceased at the crash site, officials reported. Additional information has not yet been released.

Seeking Financial Compensation in a Wrongful Death Car Accident Case

The consequences of a catastrophic motor vehicle collision may prove fatal. When a crash claims a close relative’s life due to another party’s negligence, surviving family members may be entitled to seek financial compensation for their losses. A wrongful death action allows the deceased’s immediate family to hold the other party accountable for their losses and their loved one’s demise. A successful case result requires four elements to be present. These include the duty of care owed to the deceased, a breach of duty of care that occurred, the breach that was the direct cause of the fatal incident, and damages that occurred.

A wrongful death case can be filed against any party whose actions contributed to or caused the incident that claimed a loved one’s life. This may include manufacturers of defective vehicles, government agencies responsible for safe roadway design and sufficient road maintenance, negligent drivers, and more. Most cases seek the recovery of economic and non-economic damages. These generally include funeral costs, medical bills for final injuries (via survival action), lost prospect of inheritance, loss of support, mental anguish, loss of companionship, loss of the decedent’s financial support, and more.

Seeking maximum compensation in wrongful death cases may be challenging. This is attributed to the strict legal rules, procedures, and deadlines that must be met in these matters. However, a knowledgeable and compassionate California wrongful death attorney can assist surviving family members in navigating the process to obtain full financial compensation. Who Can File for Wrongful Death?

In California, the law provides priority to the immediate family of the decedent seeking recovery through a wrongful death claim, like the deceased’s children, spouse, or domestic partner. If these relationships do not exist, then surviving parents, stepchildren, putative spouse, and other close relatives who are dependent on the deceased for financial support can file a case. To ensure that the case is in good standing if a mutual settlement agreement is not reached with the opposing party, it must be filed in civil court within two years of the incident date.
