Seeking Compensation in a Head-On Collision Case
Head-on collisions tend to be the most dangerous out of the many different types of motor vehicle crashes. This is due to the impact velocity involved in these car accidents. As the involved vehicles collide head-on, they may overturn and crash into other vehicles or objects in their path. Some of the major injuries commonly seen in these auto wrecks include spinal cord injuries, broken bones, internal trauma, cervical sprain, head trauma, etc. In some extreme head-on collision cases, a loss of life may occur.
In California, family members whose loved ones suffered fatal injuries in car accidents due to the negligence of others may have grounds for a wrongful death claim. Eligible parties may seek reimbursement for their financial losses and the intangible harm they experienced because of their close relative’s demise. California law is specific about which survivors may recover damages if a wrongful death action is successful. Those with priority generally include the spouse, children, or domestic partner of the deceased. Based on the facts of the case, other relatives may be eligible for filing.
California law also establishes a time limit for filing a lawsuit for wrongful death. According to CCP 335.1, eligible claimants have a maximum of two years for filing. It is essential to note that exceptions may be applicable to the two-year statute of limitations. As such, it is best to consult with an experienced California wrongful death lawyer to learn how the statute applies to your case.
