Out-of-Control Vehicles and Their Dangers
An out-of-control vehicle can cause a critical injury collision involving others, especially if it happens inside a city. Pedestrians are especially vulnerable and often suffer severe trauma in these types of accidents. Most of the time, the driver loses control of the vehicle because of their own negligence. They may have been speeding, distracted or intoxicated, which can easily lead to a crash. When this happens, the pedestrians who suffer trauma may decide to file a claim against that negligent driver to recover damages. The following damages are often available:
- Wages: When a pedestrian suffers injuries in an accident, they can lose wages because of the inability to work, especially if the collision caused serious trauma. Those lost wages can be recovered as well as the loss of benefits such as their retirement earnings and insurance coverage. If the injured person returns to work but has to take a lower-paying position due to their trauma, the salary difference is recoverable. Those who become permanently disabled may recover their wages until retirement age.
- Medical expenses: When a pedestrian is involved in a crash, they may face high medical bills. The cost of their treatment is recoverable, including hospitalization, doctors’ bills, medications, surgeries, and anything else related to their trauma. When they go home, they can still recover the cost (gas/parking/rideshare) of their doctor’s visits as well as the cost of medical devices (walker/wheelchair, etc.).
- Pain and suffering: Compensation is recoverable for the physical and emotional suffering following a critical injury collision. Those involved in accidents often suffer from depression, anxiety, sleeplessness and other symptoms that prevent them from going back to their former life. If treatment is required to address those problems, the cost is also recoverable.
