Filing a Claim for a Personal Injury or Wrongful Death
When you have suffered an injury or lost a family member in a West Sacramento traffic crash caused by another’s negligence, you or the family can file a claim to recover compensation. An accident attorney can help by determining fault, collecting the evidence that supports your claim and handling the negotiations with the insurance company for the at-fault driver. If negotiations stall out or the insurance company refuses to pay fair compensation, the lawyer can then take your case to civil court if necessary.
Filing a Personal Injury Claim
Filing a personal injury claim can help you avoid the financial distress of an accident injury and compensate you for your losses, including:
- Medical expenses you incur as a result of your injury are recoverable.
- If you are unable to continue working due to your trauma, your lost wages can be recovered.
- Compensation is allowed for your pain and suffering, including emotional trauma.
Families who file a wrongful death claim after losing their loved one in a West Sacramento traffic crash due to a negligent driver may recover the following:
- The wages and other perks of the job the deceased would have earned until their retirement age are recoverable.
- The family’s cost for the funeral and other end-of-life expenses can be recovered.
- The spouse may obtain compensation for their loss of love, moral support and consortium the decedent provided.
- The decedent’s children who obtained their support from him/her may recover compensation for their loss of parental nurturing and guidance.
- Loss of inheritance can be recovered in some cases.
- Loss of household assistance refers to chores the decedent normally performed around the home, such as tax preparation, auto and yard care, cleaning, cooking and more. Since the family will have to pay someone else to do those chores, the cost is recoverable.
