The first questions many people ask is what is a wrongful death? When a person passes due to the misconduct or negligent behavior of someone else, it is possible to label this death as a “wrongful death.” What are some of the components that must be present for a death to be categorized as “wrongful?”
The Death of a Human Being: The term is wrongful death. For this term to be accurately applied, someone has to have passed away.
The Negligence of Intent: Once the death of an individual has been established, it is important to identify the circumstances that led to that person’s catastrophic personal injury and death. If the actions of another directly led to the passing of an individual, this could be labeled a wrongful death and, possibly, murder. If negligent behavior on the part of an individual led to that person’s death, this could also categorize the death as wrongful. This could mean lack of adequate supervision, lack of adequate training, or inadequate safety precautions, among many other situations.
Common Examples of a Wrongful Death Situation
There are many different situations that could lead to traumatic injuries and a wrongful death. Some of the common situations include:
Medical Malpractice: When people visit the doctor, they expect their medical problems to be taken care of. Inexcusable surgical mistakes, syringe swaps, and pharmacological mistakes are all situations that could lead to a wrongful death due to medical malpractice.
Automobile Accidents: While some auto accidents may be unavoidable, there are certain situations that could lead to a wrongful death. These include distracted driving (texting and driving in California), drunk driving, negligent driving, reckless driving, or unsafe driving in a construction zone.
Occupational Exposure: There are many people who get hurt in the workplace due to poorly maintained equipment, inadequate safety procedures, inadequate training, and product liability issues. All of these could lead to workers compensation or a wrongful death.
Criminal Behavior: Criminal behavior could directly result in the death of another person, possibly leading to a criminal case.
