What is a Wrongful Death Claim and How Does it Help Survivors?
The loss of a close relative is undoubtedly one of the most challenging and painful situations anyone may ever experience. When faced with such a loss, a family member may be overwhelmed and require time to grieve and come to terms with the situation. However, there are responsibilities that must be fulfilled, and survivors must keep going. While there are no ways of ever making up for the loss of a family member, a wrongful death claim may help survivors find the resources they need to provide for a more secure future.
These cases are subject to strict filing criteria and deadlines. Surviving family members have two years to file a wrongful death lawsuit from the date of a loved one’s death, as outlined in the California Code of Civil Procedure Section 335.1. This must be followed as not accepting an insurance settlement and failing to file within the two-year statute of limitations may result in the court dismissing the case.
It is essential to conduct an independent investigation of the circumstances surrounding the car accident resulting in death as evidence necessary in proving the case may be lost or destroyed over time. This is crucial as the insurance company may dispute the incident as a way of limiting their financial liability for the fatal crash. If you have lost a loved one because of a fatal car accident in Oakley or any of the communities in Contra Costa County, discuss your case with an experienced wrongful death lawyer.
