Terminous Fatal Rollover Crash Occurs Near Stockton
Fatal Rollover Crash Reported on State Road 12
A Terminous fatal rollover crash near Stockton occurred on April 10 when a vehicle went off the roadway. A caller on eastbound State Road 12 just west of the Tower Park Bridge reported the accident to the California Highway Patrol (CHP) around 2:00 p.m. A Lexus exited the roadway and was overturned in a ditch about 20 feet down.
Terminous Fatal Rollover Crash Being Investigated
Emergency responders with the Stockton Fire Department and a tow truck were called to the scene. Unfortunately, medics determined the driver of the vehicle had perished in the crash, and the San Joaquin County Coroner was called to the accident site to declare that person deceased. The Coroner’s Office will release the deceased’s name when the family has received notification of the death. A determination of how the fatal accident happened is underway by CHP traffic crash detectives.
Causes of Run-Off-Road Accidents
Accidents where the vehicle leaves the roadway commonly occur. While some are due to driver errors such as speeding, others are caused by outside influences:
- Hit-and-run or aggressive drivers: A driver who strikes another vehicle or forces it off the roadway and then flees can cause a Terminous fatal rollover crash. By investigating, an attorney can determine if another vehicle was involved. If the other driver can be identified, they can be held responsible by the surviving family.
- Roadway neglect: If the roadway has potholes, weak or damaged guardrails or other problems, the government entity charged with maintenance may be liable for a fatal accident. Because you have only six months to file a claim against the government, help from an accident lawyer would be a good idea.
- Defective auto parts: In some cases, a defect in an auto part can cause a driver to lose control of their car in a Terminous fatal rollover crash and run off the roadway. The family may hold the auto manufacturer and others in the distribution line financially responsible. An accident lawyer can help them file an auto product liability lawsuit to recover compensation.
Recovering Compensation by Filing a Wrongful Death Claim
The spouse and children of the decedent can file a wrongful death claim when it is shown that negligence caused the death of their loved one. Recoverable damages following a Terminous fatal rollover crash include:
- The wages the deceased loved one would have earned are recovered until they reached retirement age. In addition, the family can recover compensation for their benefits, such as insurance coverage and pension.
- Funeral and burial or cremation costs are recoverable.
- The surviving spouse can recover compensation for loss of affection and consortium.
- Children can recover compensation for losing their parent’s nurturing and guidance.
- The loss of household assistance is recoverable.
