Run-Off-Road Crashes and Rollovers
Vehicles frequently leave the roadway and cause a fatal Woodland accident involving a rollover. These incidents often stem from reasons like driver error, including speeding, or external factors. However, other factors may also be involved, such as the following:
- Hit-and-run or aggressive driving incidents: An aggressive driver might hit another vehicle or force it to leave the road, leading to a fatal crash. Attorneys can investigate to see if another vehicle contributed to the crash. Identifying and holding the other driver accountable is possible, allowing the victim’s family to seek justice.
- Neglected road conditions: The government entity responsible for road maintenance is liable if potholes, damaged guardrails, or other roadway defects cause a fatal accident. Victims have a six-month window to file a claim against the government, with legal assistance enhancing their chance of success.
- Faulty vehicle parts: A defect in a vehicle part might result in the driver losing control, causing a fatal Woodland accident and leading to a run-off-road incident involving a rollover. The victim’s family can pursue financial compensation from the auto manufacturer and the distribution chain through an auto product liability lawsuit, facilitated by an accident lawyer.
Your injury lawyer can investigate to determine fault and gather the evidence to support your compensation claim. In some cases, multiple entities might have contributed to your accident. All those can be held liable for their share of your damages.
Pursuing a Wrongful Death Claim for Compensation
The spouse and children of the deceased can pursue a wrongful death claim if negligence leads to their loved one’s death. They can seek damages for:
- Lost wages and benefits the deceased would have earned up until retirement, including insurance and pension benefits.
- Costs for funeral, burial, or cremation.
- Compensation for the surviving spouse’s loss of affection and consortium.
- Compensation for children’s loss of parental nurturing and guidance.
- Compensation for the loss of household assistance is also claimable.
