Personal Injury Claims And What the Injured Can Recover
You can seek compensation if you’ve been injured in a traffic accident due to another driver or entity’s negligence. The types of personal injury damages you may be entitled to include:
- Medical Expenses: Costs associated with the medical treatment of injuries sustained from the accident, such as hospitalization, surgeries, ambulance fees, physicians’ bills, medications, tests, and rehabilitation, can be claimed. These expenses can be substantial depending on the severity of the injury. If your injuries caused by the two-vehicle Sacramento collision have not been resolved by settlement time, the lawyer can use testimony from physicians to estimate the additional time it will take. The additional medical expenses can be added to your claim.
- Lost Wages: If you cannot work due to your injuries, you can claim compensation for lost wages. This includes any vacation leave or sick time you have used. Self-employed or contract workers can use tax filings and other documentation to prove their earnings. If you have to work at a job that pays less due to your injury, the difference in your former and current pay is calculated and added.
- Reduction in Earnings: If you cannot return to your previous job and must take a lower-paying position, you can claim the difference in salary.
- Permanent Disability: If your injuries result in permanent disability, preventing you from working, you can claim for lost future earnings until retirement age. This includes anticipated bonuses, pensions, and insurance benefits.
- Pain and Suffering: Compensation for physical pain resulting from the accident can be claimed, as well as for psychological and emotional trauma. For instance, many accident survivors develop post-traumatic stress disorder, which is also compensable, according to the National Institutes of Health.
Filing Your Claim Before the Statute of Limitations Expires in a Two-Vehicle Sacramento Collision
California has a two-year statute of limitations within which a personal injury claim must be filed. That is within two years from the date of the two-vehicle Sacramento collision. If the claim isn’t filed within that date, the court will refuse it. However, because evidence and witnesses can disappear, beginning as soon as possible amplifies your opportunity to recover damages.
