Accident Fatalities Caused by a Minor

California Civil Code section 1714.1 makes parents or guardians legally responsible for the actions of their minor children if those activities cause harm to another person or in occurrences such as a fatal intersection accident. This means that if a child, for example, breaks a neighbor’s window or injures someone in a collision, the parents or guardians can be held liable and may have to pay for the damages or injuries caused by their child’s actions. The parents are sued for parental negligence, which your lawyer can further explain to you.

Recoverable Damages in Wrongful Death Claims

When a fatal intersection accident is caused by another’s negligence, the surviving spouse and children of the decedent may be entitled to recover various damages. These damages include:

  • Funeral and burial expenses: Costs related to the funeral, burial, or cremation services
  • Loss of income and benefits: The decedent’s projected income and benefits, such as insurance and pensions, up to retirement age
  • Loss of consortium: The surviving spouse can claim damages for the loss of companionship, moral support, and affection
  • Parental guidance and nurturing: The decedent’s children may seek compensation for the loss of parental guidance and nurturing
  • Household assistance: Compensation can be sought for the loss of household services and assistance previously provided by the decedent
