The motorcyclist died at the scene. The motorcycle was towed as evidence, and CHP traffic accident detectives are investigating the cause of the collision. It was not reported whether investigators suspect that another vehicle was involved.

Determining the Cause of a Fatal Motorcycle Accident

In addition to a police investigation, an accident lawyer with the experience and resources to do so can investigate a fatal motorcycle accident near Napa and determine the reason for the accident. Some of these accidents are caused by an error by the rider. However, other reasons may include:

  • Negligent or reckless driving by other motorists can lead to a fatal motorcycle accident.
  • Poorly maintained roads or hazardous road conditions, in which a claim can be filed against the government entity. Since there is a six-month deadline to file this type of claim, getting help from a lawyer would be advisable.
  • Vehicle manufacturing defects can cause a fatal motorcycle accident near Napa. The motorcycle must be retained so that it can be examined for defects. If a defect is found to have led to the fatal motorcycle accident, the family can file a product liability claim against the manufacturer and others.
  • Driving under the influence of alcohol or drugs is a common cause of all types of collisions.
  • Distracted driving, such as texting or using a phone, is the number one cause of motor vehicle accidents.
  • Hit-and-run drivers may leave evidence that they caused an accident involving a motorcyclist.

An experienced accident lawyer can identify these factors through an investigation and possibly locate any driver who fled the scene, which can be crucial in determining liability and securing compensation for the victim’s family.

Filing a California Wrongful Death Claim

In California, the statute of limitations for filing a wrongful death claim is typically two years from the date of the deceased person’s passing. This time frame is established to ensure that claims are presented in a timely manner while evidence is still fresh and witnesses’ memories are clear. The wrongful death claim is normally filed by the spouse and children of the deceased. However, siblings and parents may file if the decedent had no spouse or children.
